Terms of Use
By using POTS Compass ("the App"), you agree to these Terms.
1. Educational tool, not a medical service
POTS Compass is an educational tool. It is not a medical service. It is not a substitute for advice, diagnosis, or treatment from a licensed clinician. It is not intended for use in emergencies. It is not HIPAA-covered.
Nothing in the App, including content from Emery (our AI coach) and any provider-contributed insights, constitutes a clinician-patient relationship with you.
2. Emergencies
If you may be experiencing a medical emergency, do not use the App. Call 911 or your local emergency number, or go to an emergency department. Examples of medical emergencies include chest pain, severe shortness of breath, fainting with injury, sudden neurologic symptoms, or thoughts of harming yourself.
If you are in a mental health crisis in the US, call or text 988 for the Suicide & Crisis Lifeline.
3. AI-generated content (Emery)
The App includes a conversational coach ("Emery") powered by Anthropic's Claude AI. Emery's responses are AI-generated and may be incorrect, incomplete, or out of date. Emery is not a clinician, does not diagnose, does not prescribe, and cannot be relied on for individualized medical advice.
You should not act on Emery's responses without consulting a qualified clinician.
4. Provider-contributed content
The App may include educational content contributed by clinicians ("Provider Insights"). This content is offered for general education and is not a substitute for personalized medical advice, even if you happen to be a patient of the contributing clinician.
5. Your responsibilities
You agree to:
- Use the App for lawful, personal, educational purposes
- Not rely on the App as your sole source of health information
- Not use the App to make diagnostic or treatment decisions without a clinician
- Not represent yourself as a clinician on the App if you are not licensed
- Not attempt to abuse, overload, reverse-engineer, or interfere with the App
- Not submit content that is unlawful, harassing, or infringes others' rights
6. Account-free use
The App does not require an account. Most data stays on your device. If you choose to operate in "provider mode," you confirm you are a currently-licensed clinician and that information you submit is accurate.
7. Intellectual property
The App's code, design, written content, and visual assets are owned by Spangler Development LLC or licensed to it. You may use the App for personal use; you may not copy, redistribute, or commercially exploit it without permission.
You retain ownership of the data you enter. Submitted Provider Insights, if any, may be displayed to other users of the App as part of the educational library.
8. No warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SPANGLER DEVELOPMENT LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. Indemnification
You agree to indemnify and hold harmless Spangler Development LLC and its operators from any claims, damages, or expenses arising from your misuse of the App or your violation of these Terms.
11. Termination
We may suspend or end your access to the App at any time, with or without notice. The disclaimers and limitations in these Terms survive termination.
12. Governing law
These Terms are governed by the laws of North Carolina, United States, without regard to its conflict of laws rules.
13. Changes
We may update these Terms. Continued use after a change means you accept the updated Terms.
